Non-Consensual Deepfakes Pornography in Islamic Law: Protecting Bodily Integrity, Privacy and, Honour

Abstract

This paper analyzes the phenomenon of how deepfakes are used for non-consensual pornographic content. Based on a descriptive-analytical method with a critical studies approach and an interdisciplinary approach, this paper aims to examine this phenomenon and analyse it with Islamic law. The paper suggests that more attention should be paid to the phenomenon of non-consensual pornography, especially the use of deepfake. This approach is based on the finding that the use of deepfakes for non-consensual pornography violates the principles of bodily integrity and honour enshrined in al-maqashid as-syari'ah. Furthermore, as a new phenomenon, the use of deepfakes for non-consensual pornography is a complex crime involving data theft, qazaf and pornography, which are crimes in Islamic law.
